ARTICLE 1 - CHAMP D'APPLICATION

These General Conditions of Sale establish an agreement between LIBACI, a simplified joint stock company with capital of €1,000, registered with the RCS of Nanterre under number 982 712 333, whose head office is located at 120-130, Rue 8 Mai 1945 92000 Nanterre (hereinafter referred to as "LIBACI") on the one hand, and any person who has made a purchase on the site www.libaci.com, hereinafter referred to as "the Customer", on the other hand. The main characteristics of the Products and in particular the specifications, illustrations and indications of dimensions or capacity of the Products, are presented on the site www.libaci.com, which the customer is required to read before ordering.

The choice and purchase of a Product are the sole responsibility of the Customer. Any purchase on the site www.libaci.com (hereinafter the “Site”) automatically entails acceptance of all of these conditions.

Product offers are within the limits of available stocks, as specified when placing the order.

These General Terms and Conditions are accessible at any time on the website www.libaci.com and will take precedence over any other document.

Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

The products presented on the site www.libaci.com are offered for sale for the following territories: Metropolitan France, International.

In the event of an order to a country other than mainland France, the Customer is the importer of the Product(s) concerned.

For all Products shipped outside the European Union and Overseas Territories, the price will be calculated excluding taxes automatically on the invoice.

Customs duties or other local taxes or import duties or state taxes may be payable. They will be the responsibility and are the sole responsibility of the Customer.

ARTICLE 2 - PRICE

The Products are supplied at the current prices appearing on the site www.libaci.com, when the order is registered by the Seller.

The prices are printed in euros all taxes included.

The prices take into account any reductions that may be granted by the Seller on the sitewww.libaci.com.

The Seller reserves the right to modify its prices without notice.

The prices do not include processing, shipping, transport and delivery costs, which are invoiced additionally, under the conditions indicated on the site and calculated before placing the order.

The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.

ARTICLE 3: PRESENTATION OF ARTICLES

The seller makes his best efforts to ensure that the photographs of the Products conform as closely as possible to the Products actually delivered to the Customer (color of the Products in particular). However, it cannot guarantee that the Products will be exactly identical to the photographs, in particular due to the technical constraints of making the photographs available on the Site. ARTICLE 4 - ORDERS

It is up to the Customer to select the Products he wishes to order on the website www.libaci.com, according to the following terms:

The customer chooses a product which he places in his virtual basket, a product which he can delete or modify before validating his order. They will then enter their contact details on their user profile or log in to their customer area and choose the delivery method. After validation of the information, the order will be considered final and will require payment from the customer according to the terms provided.

Product offers are valid as long as they are visible on the site, within the limits of available stocks.

The sale will only be considered valid after full payment of the price. It is the Customer's responsibility to verify the accuracy of the order and to immediately report any errors.

Any order placed on the site www.libaci.com constitutes the formation of a contract concluded remotely between the Customer and the Seller.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.

In the event of unavailability of one or more Products after placing the Order, the Customer will be notified by email. The Customer will have the choice of being reimbursed the amount corresponding to the unavailable Products, or of being delivered when the Products concerned are back in stock (unless definitive withdrawal from the catalog).

In any event, LIBACI cannot be held responsible for any damage suffered by the Customer, nor liable for any damages.
LIBACI may modify the assortment of products offered for sale on the Site at any time, without prejudice to Orders placed by the Customer.

ARTICLE 5 - DELIVERIES

The Products ordered by the Customer will be delivered in mainland France or in the following zone(s): International.

The delivery time begins upon receipt of your payment. In the event of force majeure or unforeseen events preventing us from making delivery, the deadline will be extended depending on the duration of the impediment.

The prices of the products displayed on the site do not include delivery costs. Depending on the amount of your order or the delivery method you have chosen, you may be charged delivery costs.

The price of each delivery option is clearly specified during the checkout process. Our standard delivery costs are offered at no additional cost. If you are unable to deliver your entire order at one time, if multiple deliveries are required, you will not be charged any additional fees for subsequent deliveries.

Libaci offers delivery costs from fifty euros (€50.00) of purchase in mainland France, with the exception of express delivery costs. For orders worth less than fifty euros (€50.00), delivery costs will be applied. These fees are calculated based on various factors, including order size, costs of shipping, handling and other services. They will be billed and collected by the site. You will find details of these additional charges during the checkout process, where they will be added to the total amount payable.

However, for international shipments, long-distance delivery charges are applied, including VAT. We will inform you of the possibility of applying these delivery costs before your order is finalized. Please note that international delivery costs will be charged and collected by Libaci. If you choose to return an item for which a long distance delivery fee has been charged, these fees will not be refunded.

If the Products ordered have not been delivered within 30 working days after the indicative delivery date, for any reason other than force majeure or the Customer's actions, the sale may be canceled at the Customer's written request within the conditions provided for in articles L 216-2, L 216-3 and L241-4 of the Consumer Code. The sums paid by the Customer will then be returned to him at the latest within fourteen days following the date of termination of the contract, excluding any compensation or withholding.

Deliveries are ensured by an independent carrier, to the address mentioned by the Customer when ordering and to which the carrier can easily access.

If your package is returned due to an incorrect address, a non-existent address, failure to collect the package from the post office or for any other reason, you will be responsible for reshipping costs. If the returned package is not claimed, the corresponding costs will be deducted upon reimbursement. If you cancel your order, you will be responsible for shipping costs.

The Customer is required to check the condition of the delivered products. It has a deadline of14 daysfrom delivery to make complaints by mail, email, telephone, accompanied by all relevant supporting documents (photos in particular). After this period and failing to have complied with these formalities, the Products will be deemed to be compliant and free from any apparent defect and no complaint can be validly accepted by the Seller.

The Seller will reimburse or replace as soon as possible and at its expense, the Products delivered whose lack of conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions provided for in articles L 217-4 et seq. Consumer Code and those provided for in these General Terms and Conditions.

The transfer of the risks of loss and deterioration relating thereto will only be carried out at the time when the Customer takes physical possession of the Products.

ARTICLE 6 - CUSTOMER-ACCOUNT AREA

If the customer already has an account, they can simply log in using the email address associated with their customer profile. This will allow them to access their orders and account information. When they enter their email address, a unique 6-digit code is immediately emailed to the customer, which they must enter to complete the login process. As such, the Client refrains from any disclosure. Otherwise, he will remain solely responsible for the use made of it.

Any deletion of an account, whatever the reason, results in the pure and simple deletion of all personal information of the Customer.

Any event due to force majeure resulting in a malfunction of the site or server and subject to any interruption or modification in the event of maintenance, does not engage the responsibility of the Seller.

ARTICLE 7 - PAYMENT CONDITIONS

The price is paid by secure payment, according to the following terms:

The price is payable in cash by the Customer, in full on the day the order is placed.

Payments made by the Customer will only be considered final after actual collection by the seller of the sums due.

The Seller will not be required to deliver the Products ordered by the Customer if the Customer does not pay the price in full under the conditions indicated above.

    ARTICLE 9 - RIGHT OF WITHDRAWAL

    ARTICLE 13 - RESPONSIBILITY OF THE SELLER WARRANTIES

    Shipping costs will be reimbursed on the basis of the invoiced price and return costs will be reimbursed upon presentation of supporting documents.

    Refunds, replacements or repairs of Products deemed non-compliant or defective will be made as soon as possible and at the latest within 60 days following the Seller's discovery of the lack of conformity or hidden defect. This reimbursement can be made by transfer or bank check.

    The responsibility of the Seller cannot be engaged in the following cases:

    • non-compliance with the legislation of the country in which the products are delivered, which it is the Customer's responsibility to verify,
    • in the event of misuse, use for professional purposes, negligence or lack of maintenance on the part of the Customer, as in the event of normal wear and tear of the Product, accident or force majeure.

    The Seller's guarantee is, in any event, limited to the replacement or reimbursement of non-compliant or defective Products.

    ARTICLE 14 - PERSONAL DATA

    The Customer is informed that the collection of his personal data is necessary for the sale of the Products by the Seller as well as their transmission to third parties for the purpose of delivery of the Products.     ARTICLE 15 - INTELLECTUAL PROPERTY

    The content of the site www.libaci.com is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property.

    Any total or partial reproduction of this content is strictly prohibited and may constitute an offense of counterfeiting.

    ARTICLE 16 - APPLICABLE LAW - LANGUAGE

    These T&Cs and the resulting operations are governed by and subject to French law.

    These General Terms and Conditions are written in French. In the event that they are translated into one or more foreign languages, only the French text will be authentic in the event of a dispute.

    ARTICLE 17 - DISPUTES

    In the event of a dispute relating to an Order, the Customer must contact LIBACI as a priority, in order to find an amicable solution, by email to the address contact@libaci.com.

    Referral to the mediator can only take place after the Client has taken prior written steps with LIBACI. Furthermore, in accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission has set up an Online Dispute Resolution platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals from the European Union.     All disputes relating to purchase and sale operations concluded in application of these General Terms and Conditions and which have not been the subject of an amicable settlement between the seller or by mediation, will be submitted to the competent courts under the conditions of law. common.
